    hi every one,We all have had attorney fees to pay.It took 70 days to get my attorney paid in full to pay for my filing.The automatic stay doesn't take effect until the filng has been done.So many things can happen in that time peroid when it comes to collections:garnishments,phone calls,etc.Frankly i think when we hire an attorney,we should we given an automatic stay at that point.i hope inthe future this will change and we can be a liitle more at ease until our actual filing is offical. What do you think?

    You could hire an attny, be all prepared to file, and then have an unexpected windfall come your way. An inheritance, win the lottery, Publisher's Clearing House, you name it. Then you don't need to file BK.

    Some people go thru the process and then simply change their minds. Find other ways to deal with their situations.

    Until the actual paperwork is filed, there is no Bankruptcy Case.

      I concur.

      It would have taken me about 3-4 months from the initial fee just to "retain," my lawyer (but I hit the lottery on a PICK4 ticket for $2000 and I only needed $1600 more to file!) It's interesting why the Trustee NEVER ASK, where did you get the money to file AS THAT is way more than what they call a "preferential payment of $600," to a Credit Card.

      Anyways, once I retained him I could start giving creditors HIS phone number. Just like the creditors send us "friendly reminder," warnings our balance is due or over the limit. Having a lawyer be able to handle their calls alleviates some of the stress while in the process of filing BK the creditors are basically getting a warning, "back off!"

        Our attorney did the same thing as CMIYC's... we were able to send the creditors away to him once he was retained. That was nice!
