    Increase in interest/fees charges between filing and discharge? Be owed after BK?

    I'm wondering what happens in the case of credit card debt with the continuing interest/fees between filing and the stopping of the matter.

    If I file (mail paperwork) on Monday and charges increase on Monday/Tuesday/Wednesday whenever, will I be held liable for extra charges after BK? Is only the exact dollar amount I file for discharged in BK or all debt with that creditor?

    Maybe I should file with numbers that anticipate the possible increase in interest/fees? Like if I owe, for instance, $10,000 maybe I should claim $10,500 or whatever to be sure all debt with them is erased.

    I do not want to owe them one penny after BK.

    It doesn't work like that. When you file BK, all actions - fees, interest - anything must cease. The balances are frozen the day you file. Upon discharge the entire debt is cancelled.

      I called the court and since I live far away they told me to mail it but in the meantime charges could drastically pop up.

      So you are saying that whatever the debt I claimed on the paperwork, even though increased by whatever amount through normal interest and fees in the interim, is covered by the BK?

          Even when you file with an attny, they're probably using the LOC balance from the most recent statement. Chances are, that number isn't completely accurate. Doesn't matter.

          As long as you list the Creditor, the Acct number, and a fairly close guesstimate of the total owed, it will be taken care of.

            When you file bk, the amount you file on is basically a good estimate. The creditors will file claims with exact amount, which you can object to. Since your chapter 7, it really wouldn't matter if they said you owed 1 dollar or a million dollars, they won't get anything. If your an asset chapter 7, you should take a good look at whatever claims they submit to make sure what they are claiming is accurate.
