    How much of what I spend in the next 90 days will i have to pay back?

    I have been using my cards I have neede too haven/t actually stopped paying so i am still payig and using with no cash left after i pay the cards. So i end up using them is it manadory you pay all of the last 90 days back?

    Once you make the decision that BK is the route you're gonna take,......... Stop charging on the cards. If you have to have the cash to live on, stop paying the CC's. Go to a total "Cash and Carry" lifestyle.

    Generally speaking, you'll have at least 4-6 months from the time you stop paying before your Creditors are gonna move to do anything. 2-3 months in regular Customer Servicing, then 2-3 months in Internal Collections. Then, your Creditors might just be to move your acct to an outside Collections firm. Generally they'll try Outside Collections before suing you.

      As far as paying the 90 days back - the presumption of fraud only applies if your purchases are for "luxury goods and services". If they're necessary expenses that you're charging, your creditor has to prove that you made the charges fraudulently if they want to make you pay them back.

          I'd stop using them

          If your filing for bankruptcy I'd just stop using the cards and just use your cash for your necessities rather than using the cards like SinkingFast says.

          I'm gonna say I've been in a hard spot with my finances for over a year, and some folks have not seen money in almost a year. Only now has one started coming after me, and that's kinda what's forcing me into bankruptcy because I simply don't have the money.

          Haven't even used the cards for a couple years.

          So as SinkingFast says, if you are filing for bankruptcy I just would stop paying the CC companies period. If you have a lawyer now ask him about it and I'm sure he'll advise the same thing, as mine over the phone advised me. (We don't meet face to face til next week).
          May 31st, 2007: Petition Filed by my lawyer
          July 2nd, 2007: 341 Meeting Held
          September 4th, 2007: Discharged and Closed.

              problem is i haven't officially stopped paying until later this month .

              I will not have cash until I actually miss a payment in 2 weeks when I get paid . Thank you all for the good advice . Iwill start using cash asap Just want to file asap so I can get out of this with out many missed payments and bad credit score because of bankruptcy and late payments.

                Oh forget your credit, once you file that BK is going to be on your report for the next TEN YEARS. Just be happy to be able to file and work on getting a fresh start OUT of debt .. you can rebuild yourself. Don't be hung up on your credit scores anymore, their probably going down down down. The only way is to look UP UP UP!
