    bad checks - certegy

    a couple bad checks I wrote have been purchased by certegy. Is this now a debt that can be discharged? I have already paid off 2 of them for $300 and have 2 more for $500, but I am not sure I will have them paid off before we file. are these dischargeable, or can I be prosecuted?

    They could report if they couldn't recover. Bad checks belong to "criminal" case/category/law, so I doubt if trustee allow "criminal" debt discharged by BK law/statue/code/regulation. Only civil debts discharged, no traffic debts, no alimony debts, and no governmentt debts (student loans) either.

      If you knowingly wrote bad checks, that is a criminal offense in most States. Some places, it's even a Felony, regardless of the amount.

      If you're talking $500 each on the checks, this is something you definitely need to discuss with your attny. 'Cause with what you've already paid, depending on the timing, you could be into the "$600 in preferential payments within 90 days of filing" timeframe.

        I agree you need to check with your attorney. Because if you wrote them knowing they were bad than that could lead to a whole lot of trouble I am sure you don't want or need.

          We have 3 "outstanding checks". One is to Kroger and the other 2 are in the Check Care System. Our attorney told us to include them. Our trustee never mentioned them and our plan has been confirmed. Kroger has filed their claim. Check Care has not. These all 3 are almost 4 years old. We never received any legal notices about any of them. I am in a Chapter 13.

            same thing here I had some small checks .. 100.00 for food and all low amounts included them in bk have not heard anything from anyone including trustee but I dont know about yours thoses are high amounts or if it would look to most as if you knowingly wrote thoses check with no money in the bank...or if banking account was closed when you wrote them .. thats very crimmnal
