    Filed Chapter 7 Pro Se, Here's how my 341 Went today!!

    Hi Everyone.. I feel so relieved. So I had to make a post to help anyone else out there who had the same stress/anxiety about the 341 meeting.

    I filed Pro Se on my own in February. I have 1 asset a old camaro that is exempt. I have no job, and my debt accumulated $13,000. I filled out the bankruptcy petition and everything all on my own. Here's how my 341 meeting went.

    I walked in the room expected a little more formal setting. However, there was about 20 people sitting in chairs, and then in another room off of this room, was where the trustee held his meetings with the debtors. I was so glad to see that, because after reading people's post on here, I thought that you are in front of everyone when your at your meeting, and I would be embarresed about that. My appointment was for 1:30. People getting called in the room were probably in there for 5 minutes each. Finally at 2:15, my name was called.

    I came in, sat down. He had me show him my I.D. and social security card. He had me sworn in by raising my right hand. He then asked me to state my name and address. He then quickly flipped through my bankruptcy petition and schedrules. He then asked these questions :

    1. Have you given any of your credit cards more $500 or more in the past 90 days.
    2. Did I own any real estate.
    3. Have I ever been divorced.
    4. Am I able to sue anybody to gain anything financially.
    5. Do I have a job.
    6. What is my car worth.

    I answered no to all of these questions.
    He then said, I find this to be a no asset case, you are free to go, and good luck! He wasn't mean or friendly, just a typical lawyer attitude.
    I was in there for 3 minutes max. I feel so happy, I was so nervous about this meeting. I brought a ton of things with, my bank statements, my bills, my car title, my kelley blue book car value, My past and present tax returns, and a couple of other things. The only items he asked for was my State ID and social security card.

    If anyone has any more questions for me, please feel free to ask..I feel really at ease now and am excited about starting over, and doing it RIGHT this time. I was never taught about credit cards, debt, interest rates, over limit fees or just the simple fact that if you can't pay for it with cash, you can't pay for it at all!!!! My life was a mess at 23. I was addicted to shopping. It was all credit card debt. I was actually having anxiety and panic attacks wondering how I am going to pay my bills. I always felt sick.It sounds so stupid but now I am having a hard time dealing with the fact that I can't buy anything. I used to go to the store or mall whenever I wanted. I can't even remember what I bought on my credit cards, I have nothing to show for it. I hope I can clean up my credit and I am getting ready for a new life of no stress!!!

    *Oh yeah, and my boyfriend said he wouldn't marry me until I was debt free...Hmmm..Hopefully he will pop the question after 7 years now!!!

      Ours went about the same as yours, nice & smooth. I'm just so relieved that it's finally over and ready to make a clean fresh start. It feels so good to pay my bills on time each month and I actually have $500 in savings.
      I learned my lessen the hard way and will never go back!

          A little more stress in my meeting

          We (wife and I) were also pretty worried. Our lawyer told us to just answer what was asked, but give no more than that. We did that, but a questions came up about any credit we might have that wasn't listed. We had an Amex card we hadn't listed because we were afraid Amex would cancel our insurance with them if we included their card (we have Amex homeowner's ins. and car ins..yes they do insurance, and they are great and cheap). We sort of gave a "we have nothing that we know of" answer. We didn't feel like we were cheating anyone because we were actually going to pay off Amex so it isn't like we were commiting fraud for personal gain. Then our lawyer actually started rambling all sorts of crap that made it look suspicious. we just looked at him like he was nuts. HE was the one that told us to stick to simple answers and now he was the one buckling under pressure. Well, it all turned out okay. Amex killed the card on their own, but left the insurance. Everything else went of without a hitch, but for about 30 seconds we were about to have heart attacks.Congrats and good luck on your life after BK.

            Actually withholding a debt from your schedules and planning to pay them off later is cheating someone, all of the other creditors that will never be paid. If they would have found out about your deciet and intentions you could have had your case dismissed (if I am not mistaken). I know this is an old post but I just wanted to make this comment in case someone comes acreoss this and thinks its an ok thing to do, its not.

In fact, the lay advice I provide is not even good. In the end remember, you get what you pay for, and here in BK land were not the best at paying.

              Please do not bump old threads, especially ones from before the bk law changes in 2005.

                1) Does bump mean comment on them?
                2) Is there any way to comment on an old thread without "bumping" it, or is commenting on any old thread forbidden/taboo?
                3) Did BK laws before 2005 allow withholding of chosen creditors so that they could be repaid seperate from the BK?

                If this is the case (no old threads should recieve comments) perhaps someone should disable comments on all threads older than xxx months. Not asking these questions to be an a**, just would like to clarify for future reference.

                  3. I'm not sure, probably not but the laws changed so much it is best not to bump them .

                  There is a list of rules for the forum in the general forum , I think by HrX or HHM.
