    HelpMeFast, how are you doing?

    I'm really interested in how your case is going because of the three $2000 cash advances you had prior to filing. Has there been an objection yet? I haven't filed yet, but I have a large cash advance from November, that's why I'm interested in your case. Hope everything is going well.

    I'm assuming this is directed towards ME (CATCHMEIFYOUCAN) I sent you a PM. I had no issues throughout my case about the cash advances. Not a single one was brought up not even my gambling addiction as that is where most of my debt is from. The only thing I can figure:

    APRIL: $6000 cash advance
    JULY: Filed for Ch13 $65,000 in debt
    AUGUST: Ch 13 341 Meeting
    SEPT: Objection to Confirmation $250 not good enough Trustee wants $800
    OCT: Meeting before BK JUDGE, must submit another plan or simply quit one job and convert to Ch7 within 15 days
    QUIT ONE JOB AND CONVERTED
    NOV: Ch7 341 meeting
    JAN: 1/8/07 LAST day for creditor Objections
    JAN: 1/12/07 Trustee files NOTICE OF ASSETS
    Creditors have until APRIL to submit PROOF OF CLAIMS
    JAN: 1/26/07 DISCHARGED but case is not CLOSED

    The way I see it MUCH TIME has gone by since APRIL, no creditor objections from the first time I filed Ch13. My twisted thoughts were I guess I TRICKED the creditors into thinking that regardless of whether they objected they would have to accept the payment plan I had set up originally in Ch13, so they left my case alone. I have read that when one is in a Ch13 plan, the creditors can object but most likely in the end they have to accept the plan because they are getting something (even if its a percentage) better than nothing!
    Since I converted, I'm thinking they have bigger FISH to fry than having to go after me in this case. MAYBE IT WAS ALL timing and LUCK being that my case was through the holidays/new years and the creditors were too busy thinking about christmas/new years to pursue me further. As one lawyer put it "I SLIPPED UNDER THE RADAR."
    But I won't be celebrating until my case shows CLOSED. My lawyer said not to worry and that I could move on. EVEN get another FULL TIME JOB. Well I've been working tons of OT since I converted so I wont be getting another job JUST YET.

      Thanks catch. It's reassuring to see your case go through with a large cash advance four months prior to filing. From what I've read here I was starting to get the idea that the 70/90 day rule was ignored by trustees and creditors because creditors can object to cash advances taken six months prior. That made me very nervous.
