Trustee hires attorney???

    Trustee hires attorney???

    Our Trustee has hired an attorney for the estate? Our attorney has told us that it is not a big deal since our case is an asset case and they sometimes hire an attorney to help dispurse assets. Has anyone else gone through it.....should we be worried?

    Our Trustee hired himself as the attorney to administer the assets. There's nothing for you to worry about.

    It seems like such a conflict of interest - I don't think they should be allowed to hire themselves.

      I'm actually very relieved to see I'm not the only one seeing this motion. Our trustee also hired herself to recover and distribute non-exempt assets. She hired herself at a rate of $150 per hour to recover and distribute our whole $253 in non-exempt tax return.
      Maybe that is why no one has been asked to file a proof of claim. It doesn't look to me like I have enough assets there to do much more than pay the attorney.
      Though in all fairness, the trustee originally was going to go after my post-petition wages. We had plenty of exemption to cover it but didn't fill out the amendment exempting it and most of our tax return until after the request to employ an attorney was made.
      Who knows maybe they plan to go after a preferential payment I made (balance transfer). Though the transfer was only $1500 and my understanding is that it usually has to be over $2000 to make it worth the time and expense involved. Plus no mention has been made of it.

      I guess now I'm just guessing at what they might be thinking since $253 doesn't seem like enough assets to be worth dispersing. That wouldn't even give everyone 1% of what I owed.
