    Question on CH 7 Asset Claim

    Ch 7 case is going well so far.

    Have question.

    The trustee asked for claims for an asset(tax return). On pacer, I see my city claimed for taxes, and sallie mae for student loans. Does that mean they are dischargable?

    No it doesn't. It just means 2 creditors have claimed a slice of the pie.
    Once the bk is discharged, you can expect renewed collection activity from the student loan lender.

      Just a question to add to this answer, I converted to Ch7 from Ch13, NO ASSET, Jan 8th was the last day of Objections, however the Trustee put a notice of assets, and sent creditors request for claims. I KNOW I HAVE NO ASSETS, and have not received any request for which assets he's looking for. It certainly wont be a tax refund for me this year as I'll owe $4000. I was discharged Jan 26th, BUT with the asset thing looming I doubt my case will close as creditors have until APRIL to submit claims. I think MOST of them have already done so. I informed my lawyer I'm really anxious about this ASSET thing even though my case is discharged, he emailed me back and said "Don't worry." Having an experienced lawyer really really is relieving !

        That is what I figured. The student loans went into forbearance during the BK process.
