    Income Question

    I've been reading these forums for awhile, and I've read a lot of good information (my appreciation to everyone). I have a situation that I don't think has been covered. We have a lot of difficulties when my wife works. We can never seem to work the same shift, there's always problems getting people to pick up our kids from school, no one to watch the kids on holidays, and the list goes on and on. I'm sure my situation is not unique. In fact, I'm sure it is typical. In any case, we easily pass the means test without her working, and we'd almost pass the test with her working. We are to the point that we can't pay our bills either way. If she should work a few months out of the year then quits her job (prior to filing), will this be viewed as abuse?

    Quiting job is not considered an abuse. If you have to take care of the kids, then you have a ready answer if the the trustee ever asks why.

    If you are barely making it and have little to no asset, the trustee is not that interested in the particulars of your circumstances. They have bigger fish to fry.

      I have almost always been a SAHM. I've worked part time and temp jobs off and on over the years. But nothing steady. We didn't get any grief from the Trustee about me not working when we filed BK.

      Being a SAHM is perfectly acceptable to the Court.

        I was working to full time jobs. Working 2 jobs is not a requirement, in order to evade paying back anything through Ch13 I simply quit one job, converted to Ch7. Now I'm discharged!

          Thanks for the replies. I was just afraid that a sudden decrease in family income might raise some red flags.
