    US Trustee

    For those who filed a 7 and had the US Trustee involved, at what point did they get involved? Pre-341? Post-341?

    For us, it was within a few weeks of filing, well before our 341.

        What brought out the US Trustee for you guys?

        Over median?

          Business ower, over $100k unsecured and a jumbo mortgage
          But mostly, it was the business he was after.

          PS: I'm Old Law - no median income or means test back then.

            The US Trustee stepped in 3 days before discharge - but then never asked anything of us and we were discharged after the extension expired - but of course it been 6 weeks and we still aren't closed yet ...........
            Filed Chap 7 6/30/06 - 341 Meeting 8/1/06 -
            Deadline for objections 10/10/06
            US Trustee extended deadline to 12/9/06
            Dishcharged 12/29/2006

              About two weeks after my 341. I have no idea what it will do to my "60 day club". The US Trustee was scheduled to review my case yesterday the 6th, no idea what that means. Nothing on Pacer regarding the US Trustee involvement yet.

                They can review all they want. You can't get blood out of rock. You didn't commit any abuse. You have no asset in hiding. There is nothing for them to work on. It wouldn't affect your discharge, CS.

                  AAI (Alien Abduction Insurance) are going to raise a red flag.

                    MARCH: applied for another cc - granted $10,000 credit line - transferred over to pay off another cc (still considered a CASH ADVANCE)
                    APRIL - gambling spree ($6000 cash advance from cc in atlantic city in 2 days)
                    MAY - checked into a DMP (unapproved by the courts) i know, dumb - eh
                    JUNE - got spooked after paying the DMP $500, and almost stood to lose another $3000 in just there fee alone! Did research and decided that BK was best in the end. SCREW the DMP. Got hooked up on this lawyers website, took the CCCS course he had a link too (approved by the courts) got certificate, retained the lawyer.

                    Note: up until the time I filed I do want to add I was still paying the creditors at least the minimum if not something! as I didn't want to look like I was commiting fraud with those big cash advances!

                    JULY - got a lucky hit, paid the lawyer $2000, filed Bk end of July

                    Stopped paying the creditors !

                    AUGUST - Ch13 341 meeting
                    SEPTEMBER - Trustee objects to plan
                    OCTOBER - Meeting before the Judge, he practically said if I quit one job I could file for chapter 7. But if I continue to work 2 full time jobs (in which the courts weren't forcing me to, than I would expect to pay back $800 a month for the next 5 years); I decided to quit one job, and converted my case to chapter 7
                    NOVEMBER - Ch7 341 meeting
                    JANUARY - Discharged

                    PENDING: Some asset(s) the Trustee thinks I have, so case may be discharged but aint exactly CLOSED, and Trustee has not sent me a letter letting me know what asset they are looking for me to give up. Cant be money, since I really don't have any. And I'm down for they year as far as gambling wins/losses anywho!


                    Had I listened to my lawyer in the beginning (quit one job) maybe my Bk would be over by now, but maybe things happened the way they did, as far as putting my cash advances further apart from my filing day/conversion date? WHO Knows.
