    ChainSmokin vs US Trustee

    ChainSmokin vs US Trustee

    US Trustee is requesting that I sign and return a consent and authorization form. It will authorize the US Trustee to obtain my credit card statements directly from the CC companies.

    They listed three specific companies.
    1. CitiBank 21K
    2. Credigy – Collector for Fleet / Providian card 21K
    3. JTL Inc. – Collector for Chase 12k

    Well at least they are not requesting that I produce these myself, most of it long gone. My last charges were 4 to 5 years ago.

    My attorney emailed me the .pdf document along with this comment…

    “I just received this from the U.S. Trustee. It should not be a problem. Please call me and I will explain the purpose of their request.”
    (I hope to talk to him tomorrow)

    I hope he is right. I’ll keep my BK pals here posted on this one.

    I would say that is much better that it is coming from the Trustee, the creditors will have to work THAT much harder, and if they can't provide him anything, well they are at a somewhat LOST !

      What is this US Trustee looking for? I can't imagine why he wants to see credit card statements from 4-5 years ago?

      I remember that sinking feeling when the US Trustee got involved in our case.......I had had better days!

        I imagine the trustee is probably making the request to simply verify your claim that you haven't used the cards in 4 to 5 years.

          Hang in there Chain!

          At least you didn't have to contact the Creditors and try to hornswaggle the statements out of them yourself!!

                A debit card has worked in its place. There was no threat to my bank account until I was sued. I answered the summons and filed for chap 7 before a judgment could be placed against me, leaving my bank account at risk.

                As to the aspect of having less income to work with, well you can probably tell it took me awhile to figure it out, LOL.

                I went from earning 60K to about 15K the first two years and it has climbed to about 22K. This kind of adjustment requires one to not only cut back, but to change the way you look at life. I believe I lead a fulfilling life, but a simple one to be sure. And now that my car has died, it is simpler still, LOL!



                I made absolutely no payments or charges in the last 4-5 years. I would say interest and penalties accounts for roughly half of my debt. Different companies handle bad accounts differently though. Things get strange when it goes to collections and stranger still when the debt gets sold.

                The Citibank amount is actually pretty close to the damage I did, on the other hand the Credigy account is over double the original balance. No rhyme or reason to this stuff.

                At least this has taken my mind off this terrible flu I'm fighting.

                  Almost mirror my story. The numbers are almost identical.

                  Isn't it funny how you can feel more fulfilled living a simple life? Strange how your perspectives change and you actually enjoy the carefree life. You are no longer in the rat race. Ironic as it may sound, I would consider it a blessing to have experienced living like this. I think it is different if you were always broke, vs you were once loaded but now broke. If you never had money, you would always wonder what it would be like. But if you have been there and done that, you don't wonder what it would be like on the other side of the shore. I am a lot happier living broke but carefree. Although, I admit I could be just fooling myself too...

                  It takes a real man to LOL over his car being dead.

                    I'm surprised they didn't request the same of me...maybe 'cause I filed under old laws....I hadn't used my cards since 2001......four years...hmmmm....I used to get alimony and that's how I made it till the end of 2004 when the alimony stopped and I found a job....

                    It's so much fun these days to tell people, can't I'm broke....(we know you've got g's hid)...nope...even took the pin number off my debit/check card....that's a big weekend cash saver right there....

                      The logic is simple to understand but I think many such as myself need to be rattled to the very core before believing it.

                        The thing is, we didn't get to where we are by choice. We are here by circumstances. But after being to both sides of the river, you can be stoic about the situation. You can have money pouring in every 2 weeks and still not happy. Yet you can be flat broke, and yet at peace. It is something you have to actually live it, to realize what it means.

                        The most precious thing I have come to realize is actually our health. When I was doing well, I didn't think about getting into shape or into good health. Now when I see well to do people who are out of shape, I feel sorry for them. They have all the resources and yet, they don't realize they are missing the most precious thing, ie their healthy bodies. Being broke actually helps me to get into better health. It means I can only eat the basic healthy food, instead of the fancy, over processed food that are typically not nutritious. Having little money means there is no other distraction. You actually have time to exercise and live a spartan like lifestyle. Ironically, the circumstances force upon you the self discipline you don't otherwise have.
