    Looking for some help

    I have just recently filed Ch. 7 in Nov. On my petition I listed the student loan debt that I have. I know that student loans can not be discharged, but should I have not listed my student loan debt? I have already had my 341 meeting. I'm a little worried. I also fille pro se, so I had no advice going into this besides what I read. Any help would be great.

    It sounds like you did it correctly. Student loan debt is listed along with your other nonsecured creditors. It's just not dischargable so you will be responsible for payments on them after bankruptcy. I remember being suprised that nondischargable debt didn't have it's own seperate space on the petiton, but it doesn't.

      Thanks for the reply. I found out after I listed my student loans that I can't pay on them. So I guess after my discharge I will be able to?

        Most student loan providers place your loan in automatic deferment or forberance during the automatic stay. Payment is reinstated after discharge.

          Even though your student loans are in forebearance, they can and will still charge you interest. Some government and private lenders will still take payments during bankruptcy if you are able to do so, but because of the automatic stay, they will not provide you with any payment reminders or accounting on paper until your case is discharged and closed.
