    Over the Median, how many......???

    Just wondering what the chances are of getting to file a Chapter 7 if we are over the Median? The paralegal we spoke with yesterday seemed to think we have a pretty good shot at it. She said after she enters all the info, if a green face comes back, we're good to go. If it's yellow, we need to do a little work.
    I haven't been on this forum long, so I don't know how many have gone on to a 7 if they are over.

    well we are one of them as of 1/12/07
    We were 20,000 or more over the median. In fact, my husband was over it with just his salary alone We had no income left over to pay into a 13 but knew we could had been converted because of college tuition on our expenses, but we were blessed with no objections at all.
    We are in North Carolina and I realize that trustee's are different throughout the courts. As long as you don't have any extra income left over you should be ok if your trustee does not nick pick. I still think if your lawyer has a good relationship with the trustee, you will have no problems. Good luck!

      Something like 90-95 percent of Chapter 7 filers are over the median...
