    please point us in the right direction

    My husband and I have been considering filing bk. Drowning in debt has turned into drowning in too much information about what to do about our debt. We basically have no assets, a lot of different creditors, low income and a family of 5. We keep seeing that it is unwise to file yourself, but if we could afford a lawyer, we could afford to pay our creditors. Is it really dangerous to file yourself? What about these full-service companies, are they worth looking into? We are also in the process of moving, we read that you needed to be in a residence for 180 days to file, is this true? Sorry for so many questions, but does anyone have any good advice?

    It can be dangerous to file yourself (pro se) without FULL KNOWLEDGE the laws and codes associated with Bankruptcy.

      If you're changing States of residence, you do need to be in the new State 180 days prior to filing. If you're just moving across town, or to a different City within the same State, there is no minimum I know of.

      Having the money to pay an attny is not the same as having the money to pay Creditors. We paid our attny $2K. A one time fee. We were paying nearly $3K/month, EVERY month in minimums. So, for less than the price of paying minimums for ONE month, we resolved our debt issues.

      You can file Pro Se. But as BassBoy said, don't just jump to fill out the paperwork and hope for the best. Research and learn before you attempt it on your own.

        Don't forget, the initial consultations are usually free. At least start with that and see how you feel. With the new BK laws, it seems very risky to try this on your own - though if you're very careful, meticulous, and willing to do hundreds (thousands?) of hours of research and planning, I bet it can be done.

        Do not, under any circumstance, go with either a cut-rate/discount lawyer, or a BPP (BK petition preparer) - they will ruin your case.
