    Listing creditors

    I am listing citibank as one of my creditors. A collections agency is comming after me for the amount owed to citibank. How do I list these when filing? Citibank only? both? or what?

    You need to list all unsecured and/or secured debt, you cannot pick and choose!

      You list both the original creditor and the collection agency. Basically you are just making sure that everyone gets a notice of your BK. Let them work out their own reconciliation. That is their problem. Not yours. Your responsibility is to makesure they are on the list, so they get mailed a copy of of your BK.

        What I did and it was on the advice of our attorney was list the original creditor, the address of their legal dept. if available and the account number and balance. Then right underneath that OC I listed the collection agency/law office it was currently with, address, account number and amount and put "collecting for (OC's name)". That way both the OC and the collection agency collecting on that debt both were notified.

          Then you have covered all your bases. Everything should be just fine.

            List Citi with their address, dates you've had the acct, MC or Visa charges, and the $$$ amount of the debt first.

            On the next line below that, in the first column that says, Creditor's Name, Mailing Address, etc", write "Representing Citi". Next box to the right on that line, fill in Citi on the first line. Then c/o, and fill in the CA's name, mailing address and such. You don't have to post the $$$ amount.

            For CC's where you might have several CA's, just repeat the instructions above.

            Discharged - 12/2006
            Officially Declared No Asset - 03/2007
            Closed - 04/2007

              List everything and everybody. Anyone who pursues you as a collection agency you list as a duplicate claim.
