Our attny's paralegal emailed us that our case had been filed and gave us the case #. I logged into PACER and checked. It was already there. Our paralegal and another gal job share. One works M/W half day Fri. Our paralegal works T/TH and half day Fri.
We went in on Tuesday to review our paperwork and sign. The paralegal went over everything with us. We had to update some debt #'s so the paralegal told us not to date anything. She would would update the figures, have the attny review everything one last time, and file our Petition when she came back in on Thursday.
Maybe your attny has not actually filed your BK yet??

Signing the paperwork at the attorney's office and having the BK papers filed with the court and having a case number are two different things. Your att. will mail you a copy of all paperwork with a BK case number on it along with a copy of the court clerk signature form saying the court received said documents...etc. At least this is what our attorney did. We signed all paperwork after looking over on a particular day, and the attorney filed with the court like two days later. Perhaps you are jumping the gun just a bit and it's not filed with the court quite yet. Simply call the attorney if you can't wait (patience is not my virtue either) and asked if they've filed with the court yet so you can get a BK case number incase collections or something calls.

The case shows up on PACER "instantly" when it is filed. There is no delay as all cases handled by attorney's are required to be e-filed. Thus, if you are not showing up on pacer, then your attorney has not filed your case or you are looking in the wrong BK district.
Thanks BKTANGO....good advice. The matter is out of my control. No use getting upset about it. It's just that when he said he filed on Fri june 26th (apparrently they their office files once a week) and he said that I would probably get a court date info by Monday June 29th....but that never happened. Then when I called him on Thursday he said maybe the courts are behind because of July 4th holiday. Now it's Tuesday and he is apparrently not in his office and none of this peers has any information about my case! I will call the office tomorrow and hopefully get to the bottom of this. The parallegal who said she would look into the matter said she would call me back and NEVER DID. They are very BAD ABOUT RETURNING PHONE CALLS. I think that is very unprofessional.
