    11/28 Discharge...

    Well I checked PACER today and it says my case is DISCHARGED!! I didn't realize how stressed I have been, until I saw the discharge.. What a relief!!

    I can't see the discharge letter yet, though..

    Also, the trustee submitted a no distribution report, but I can't actually read it either. In another thread it was mentioned that the trustee might wait until after 2006 taxes are filed and may go after the refund?? How do I know if that is a possibility with my case?

    I would just call the Trustee, it doesn't hurt to ask, I seem to see THAT ALOT .. that the Trustee is holding off on discharges to see if you they can take your refund! But what I don't understand, if you are filing for Ch7, what the heck do they want your refund for? Admin fees? Pay the creditors a couple bucks? WHO KNOWS !

    Congradulations on the DISCHARGE, cant wait for mine! Come January!

      Did the Trustee express an interest in seeing your 2006 filed taxes at your 341??

      In the last 2 years prior to filing, did you receive substantial income tax refunds. In excess of $1000??

      At any point since your 341, has your attny sent you a form letter from the Trustee explaining about wanting to review your taxes? The letter contains instructions on the procedure you need to follow regarding turning the check from the IRS directly over to the Trustee.

      You are required to sign and return the letter acknowledging that you've read and understand the terms and consequences. If you do not follow the Trustee's instructions in the letter, you risk loosing your Discharge and having your whole BK dismissed.

      If neither of those things happened to you, then most likely the Trustee is not interested in your income tax refund next spring. Hopefully, you'll be seeing CLOSED posted soon on PACER.

        The trustee never mentioned it at the 341 and I have not received a letter stating that they would like to review it.. I have had some significant returns though, usually between 4-6k.

        On my business loan, I told the bank I would be filing BK and the VP "promised" that my tax returns would be taken from now on since it was an SBA loan... I just hope to see CLOSED on Pacer soon.

        BTW, when should I receive my discharge letter in the mail, and when should I accept a cc offer? I have gotten several offers in the mail. I filed due to a bad business decision, not because of credit card trouble but since filing BK all of my credit cards have dropped me. Really unfortunate because my credit score was great before this.

            You should get a Discharge letter in the mail.

            Generally here, what you see on PACER electronically, immediately, arrives in the mailbox about a week later.

            Our filing notice was posted 9/12 and we got the letter from the Court in the mail a week later.

            If you have a notation of No Assets showing on PACER, but the Trustee hasn't posted a scanned copy, you might try calling your attny. I'd think your attny has a copy of the letter in your file.
