I filed chapter 7 pro se, and apparently the court was missing some paperwork, so they stopped the bk. I quickly sent in the missing paperwork, but in the mean time, and having issues with the bank. I had 2 vehicle loans. One a car, that I signed back to the bank immediatly, and the other a truck that we all signed a reaffirmation agreement on. Now the bank is reposessing the truck since the court sent them a letter stating the bk7 had been discharged. I keep calling the court to see if my case has been reinstated yet, but not yet. What happens if they take the truck, and then my case is reinstated? Do they have to give the truck back? Do I have any options? Thanks for the advice!!

GO TO THE COURTHOUSE ASAP if you don't have access to pacer and check the status of your case. The clerk should be able to tell you this on the phone. If they repossess the vehicle while you are not protected from BK then you are not protected from the automatic stay. I would do whatever it takes to find the status of your case TODAY!!
One other question: Was your case dismissed? You said "discharged" in your post, which would mean a successful BK. And did they file a motion to dismiss the case or did they actually dismiss the case? Please give us more info so that your question can be answered.Chapter 7 Pro Se....Discharged Feb. 2006
