    Student Loans

    I understand that student loans can't be discharged and we have been current on them before and after filing. Now since we filed, the dept. of ed. has stoped sending us monthly statements with coupons. I looked on line and the status of our student loans says "suspended", what does that mean?

    I would like to know the answer to this also. Most of my loans (with Sallie Mae) are in forbearance, one is in repayment (current), and one, unfortunately, just started wage garnishment!! :o

    When I called the guarantor, they said that even though the loans were not dischargable in BK, that the stay does apply and the garnishments would stop. I have no idea whether this is true or not.

    I'm filing the week of March 21. If anyone has experience with this, help us out!

      It has to do with the automatic stay that goes in effect when you file BK. Even though the debts are non-discharagable, they are still a debt and they cannot make any effort to collect it i.e. send you a bill, etc.

        I have another student loan question. When I signed my student loans there was a lot of stuff about if I filed for bankruptcy these loans still had to be paid - etc. When I talked to the loan company - WELLS FARGO - I asked them if my student loans were associated with federal / government. She told me no, these loans are considered private / alternative loans. Does that mean that I may have a chance to discharge them? I'm filing on my own so...I'm just wondering...

          Thank you, you're absolutely correct HHM, I called the direct loan service center and they told me that: after filing BK the student loans go in to a forbearance status. My next payment is not due until after my discharge in May.

            Yes, you can. I am doing it with Wells Fargo too. Wells Fargo is private money used for Education... not student loans from the Federal Govt.
