    Do I need to send my last year's tax return to the trustee?

    I filed just over a week ago. Do I need to send the trustee my last year's tax return? Or do i just wait and see if they ask for anything?

    Good rule of thumb: don't EVER provide any information unless asked by your attorney or the court/trustee!! EVER. but do have everything available in case they do ask for it.

      Thanks for the info!! I do have it. Just didn't want anything to go wrong and not send something I should have. I will just wait and see then!

        He took a glance at them during the 341 meeting and never asked for a copy.

          You WILL need last years tax return, it is a required document for BK under the new law.

          Section 521(e)(2)(A)(i)
          The Debtor shall provide...
          not later than 7 days before the date first set for the first meeting of creditors, to the trustee a copy of the Federal income tax return required under applicable law for the most recent tax year ending immediately before the commencement of the case...
          You will want to review Section 521 of the Bankruptcy Code to see what you must do, what documents to supply, and what not, in relation to your BK.

            BUT....the attorney will be the one to do this. Have you already supplied this to the attorney?? (are you pro se or with an attorney??)

              It probably depends upon the normal practice in your area.

              I am in the Eastern section of Michigan and after confirmation received a letter from the attorney saying (not quoted..) "Keep up the payments and everything should go smoothly. Also, send in your income tax returns each year to the trustee."

                I don't know if your district is different (I am eastern district virginia), but I filed pro se I did not send my tax return and paystubs to the trustee, and he did not request them, That did not stop him from filing a motion for dismissal based on the fact that I had not supplied them in accordance with the new bankruptcy code. Given my experience I would suggest you provide them, or at least contact the trustee's office to ask. I ended up having to refile.
