    New 341

    Just out of curiousity, now that I'm re-filing from Chapter 13 to Chapter 7, I have another 341 meeting scheduled for November. No creditors showed up at the Chapter 13 meeting, what are the chances they are going show up at the Chapter 7 hearing? Any thoughts? Also, I have a new trustee???

    They don't have to show up at the 341 and probably won't...... but they can still file an objection after the 341 meeting and during the 60 days objection period.......

      Our Trustees here are either Ch 7 or Ch 13. Ch 7 handle only Ch 7 filers, Ch 13 handle only Ch 13 filers. Probably the same in your Court as well. Possibly the reason you have a different Trustee this time.

      There were no Creditors at all at our 341. Not for us or for anyone else there that day. Just filers, attnys, the Trustee and his assistant, and US Marshalls. Chances are, if you don't have any small, local Creditors, you won't have any Creditors show at your 341 this time either.

      Our attny said generally the smaller, local Creditors are the only ones they see at the 341's.

      Closed - 04/2007

          Good to hear that you're changing from 13 to 7. How did you make it work? Did you quit one job?

            Quit One Job

            Yup Yup .. I quit one job .. I weighed everything out, it didn't make sense for me to commit the next 5 years and practically all of my paychecks to Trustee and my hard earned tax returns, when I could just quit one job and not pay anything (granted no objections or adversarys) under a chapter 7 that would hopefully get discharged (I figure come mid January). I'm pulling some OT on my night job, just so long as I dont go over the median, I should fair well for the next couple of months. It's weird being off all day, I tell you, I don't know what to do with myself but sleep, eat, sleep, eat !

              Good decision! Its hard, but what a feeling when the chapter 7 is over! Its all worth it!
