    Chapter7- happy endings?

    Has anyone filed for Chapter 7 and been discharged since the new law was enacted?Even better,were you close to/or over the median income and your Chapter 7 still went through?

      most here have. It's not that hard. Harder is trying to fight the private sector and getting your cr balances wiped clean.

      They're not as amicable as the govt. Unlike the govt, they're not on your side.

          You may not get a bunch of stories, MEA. Most people come here during the process and move on when their BK is done.

            Sinkingfast is right, most move on. I've actually not been on the boards in several months after my discharge, but ironically, returned today! It can be such an intense experience, most like to not think about it for a while!

            While the actual dates escape me at the moment (funny how when you're in the process, those dates mean EVERYTHING!), but I filed for Chapter 7 in January, and was discharged in April.

            Don't let the new laws scare you. I was just over the median income, but mine went very smoothly. Just be sure to do what I'm sure everyone else has recommended. Get a good lawyer that you can trust, and be VERY organized. That will make the process much easier than you can imagine.

              Hi Mea, we just filed chapter 7 and we are way over the median. We have really no idea what to expect, but once things start rolling I'll keep ya updated as how its going.
              9/28/06: Filed Chapter 7
              10/25/06: 341 meeting Done!
              12/25/06: Last day for objections.... Dear Santa, can we have a bk discharge for Christmas please?
              1/12/07: Discharged & closed!!

                We filed 7 in August and are well...well...well over the median. Attorney still doesn't feel it will be an issue because after all the means testing we sit at less than $100 disposable. My attorney specializes in Ch. 13 cases, teaches classes for the local bar and a local law school on the reform act and Ch. 13 and he still is confident we are gtg for a 7.

                It's so subjective though it can drive anyone insane! No concrete examples to comfort you as all cases are different. We have our 341 on Friday however and I'll be sure an let you know if the trustee agrees with the attorney. Even after however, it's on the U.S. Trustee to approve so....ARGH!

                  Do a search on "discharged" or "over median" and you'll find lots and lots of posts! (And lots of happy dances too!)

                          While your waiting

                          What happens while your waiting to be discharged in Chapter 7, creditors to object ??? Can you look to find ways to make more money (or should you wait for the discharge ???) I know I asked this once before but I lost my post and forgot to check back to see if anyone answered, sorry for the repeat. Anyone ever file from a chapter 13 to a chapter 7, and if so, how long did the process take ???
