Like everyone else, I was apprehensive about initiating the process. How do you choose an attorney, what can you expect, how are 341 Hearings handled, how rough will the undertaking be. I pored over firm after firm, and none felt right. I finally chose Mark McClure Law because honestly, he looked like a nice guy. I hit the jackpot.
He is so easy to talk to. Meetings/consultation is done by Zoom; and if you don't have that feature you can do it telephonically. Have all your information in order and he'll go through the paperwork with you. It was the easiest, most stress-free consultation, and he works with you; he even has a dog in the office that you can see in the background and while that may seem funny, it's oddly calming.
Right now, 341 Hearings are telephonic. He said I won't have to see/face anyone, you call in the number and leave your phone on mute: when your name is called, you'll have a bout 5 minutes of questions after swearing in, and then it's over. The less complicated your case is of course, the more quickly you'll breeze through it. He will be on the telephonic 341 Hearing line with you for representation. What a relief that I don't have to be seen (no in-person appearances!!); that it's all completed by phone.
I am a no asset Chapter 7 which makes it pretty easy. Not only will I be able to keep my car, all of my belongings, and my tools of the trade, but my tax refund is also exempt.
As always, adhere to the truth. Then, be organized:
1) Bank statements for the last seven months;
2) Paystubs/1099s for the last seven months
3) Photocopy of ID and SS card to send him
4) Prepare a list of your belongings/valuables to provide answers to those questions
5) Get a good idea of what you spend monthly to live: food, utilities, clothing budget, pets, phone, entertainment, all of it.
