    Really need help

    I am considering filing chapter 7 pro se. My wife was laid off from her job about 5 months ago. We made about 3500 a month now its only about 2000 a month. We have 4 children and its really hard to handle it all on your own. I did not have enough money to pay all the bills. So I stopped paying on all the credit cards. Some of them I have not paid in over 4 months. All of the cc, house and the financed vehicle is in my name. I also owe the IRS about 2000 but this is set up on a payment plan threw payrol deduction. The house payment is current and the vehicle that is finaced is current. I have no equity in my house or car. I am starting to get letters and phone calls for this bills know. I have a rental property but the tenants moved out about 3 months ago and no one currently lives in it. There is no equity in this property either. I have not made a payment on this property because I don't have the money. I understand that I will loose the rental property. Just don't want to loose the house we live in. I don't have alot just the basic stuff furniture, washer and dryer, etc. Nothing exadriate. I was looking at bridgeportbankruptcy and usabankruptcy. I have consoluted with a couple of lawyers and there fees were 1250 and 1500. I don't know which way to turn any help would be greatly appreciated.

    Hi Realllybroke. Welcome. You have come to the right place for answers, help, support and advice. do you know if you fall under the median income for your state? That will let you know if you are a chapter 7 or 13 candidate. Do you know if any of the attorneys you consulted with accept a payment plan through third party?

    I don't have many answers, alot of others here will chime in, just mostly wanted to say "Hi" .

      You can hire an attorney or file pro se, but whatever you do, don't use bridgeportbankruptcy, usabankruptcy, or anything like them. They are a scam and will rip off your money, only making your situation even worse.

        All of the attorneys I spoke with want the money up front. The lawyers said I would easily qualify for chapter 7. Since you don't recommend bridgeport or usabk. Anyone else you can recommend? Thanks

          you are filing BK, of course they want the money up front. I would like
          to file BK, but it would cost me $2,000 and my wife makes to
          much money $63k/year...but i feel you, even though that seems
          a lot, we are flat broke every month.

          there are some atty that can set you up on a payment plan,
          but no filings will take place until they are paid in full.

          I do have a suggestion, PM me.

            There are some Stickies at the top of several sections with links to online editable forms. You can also Search past threads. Various sites have been mentioned.

            Also, there's a Stickie about what Trustees look for in the New Forms. And a Stickie about how the Forms are being revised, effective in October, I think.

            Plus, the Nolo book is a very good source for info as well.

              Income - Median Test

              Hey hey

              I make a little over 60g's a year and am single and am 20g's over the median income (due to 2 full time jobs). If i quit one job sopposedly I could file a ch7.

              But I'm stuck. I took the Median Test and it showed I had no disposable income, yet my "real life budget," (I think they call it CMI) shows I have a good chunk. So I'm filing ch13.

              Depending on what you owe and how recent you used your cc's the lawyer thought it best I go for a ch13 first. Afterall I think thats what the courts kind of force you into. Payback what you can, even at $100 a month. I've had cash advances on the fine line of when I filed to how many days one should wait before they file, thats why a ch13 would be safest for me for now, they may object, but since they are getting something back it would be futile for them to fight it.

              After 6 months, if I have a hardship (like the loss of one job) I could change to a ch7, and I am working on 50 ways to get myself fired .. hee hee.

                Some law schools have legal clinics that will represent you for free. Most counties have free or reduced fee lawyers. And nearly all lawyers will work out payments plans for you (although they won't file until you've paid.)

                  I can SO relate to your comment here......my husband works two jobs too, and Dang if we don't wish he had "quit" one of those BEFORE we saw an attorney........oh well......

                    really broke

                    Hi and welcome. We have been on one income for years and unemployed more recently for 8 months and stopped paying credit cards and filed pro-se and have three kids and a house, and not much else. We can relate. For me filing was like preparing my taxes. It was not that hard. Our 341 is in four days so I can't speak to the whole outcome yet. But it has been a relief to file and it has got to be better than just letting things go to forclosure. Is there any way you can sell that rental and pay off some debt that way? Or is it lost to forclosure already? In any case you should be able to keep your house.

                    I just wanted to offer some support. Each person's situation is so unique but there are good books out there that can walk you through the paper work..

                      The rental property has negative equity in it. It really doesn't matter to much if it is lost. What books or software did you use to file your bk pro se??? Thanks in advance. Please let me know the outcome of your 341 meeting.
