    Chapter 13 to 7 conversion

    Question for the experienced. My wife and I are currently 2 1/2 years into our 5 year ch. 13, we rent a home and have two vehicles in the 13 plan. Plan payment is 1075.00 monthly. Both vehicles need to be replace. Also currently owe almost 10000 in back taxes. We have talked to our attorney about converting to a 7 and we are about 1000 over on the utah means test. He says that if we submit it and show that we are going to pay 1100 per month on the taxes it might go through. The question is: has anyone had a similar experience in converting when borderlining the means test and been able to get into more reliable vehicles while in the process of a chapter 7? If we do file the conversion and we do have to pay the 1100 per month on the back taxes we would not be able to afford newer more reliable vehicles

    I can't say that I have done this. I did convert but my vehicles were a 2006 and a 2003 vehicle and were 4 and 7 years old, respectively at conversion. It would be difficult to obtain a vehicle unless you can get a lender such as 722 Redemption to allow you to trade your vehicle (thaty have that sort of plan). Realize that the rate will be in the high teens (18-19% or higher!) and you'll want to refinance 6 months after discharge.

    (US Bank's 722 Redemption Funding also has a "keep or replace" program!)
