    Only one car reaffirmed, can I let the other one go?

    Hello all,

    My chapter 7 was discharged early this year with no issues. My attorney sent reaffirmation request for my two cars but only one company came back with paperwork to reaffirm.
    The only car showing in my credit report is the one I have reaffirmed. Question: If I let the other one been repossessed, can they sue me? will it show in my credit report as repo?

    They can't sue on discharged debt (period). I have not had the experience of a repossessed "discharged" vehicle after bankruptcy so I can't say whether it will report. I will say that it "shouldn't", but there is no law that I can recall that would prevent the lender from reporting it as repossessed on your credit report.

      I do not believe that a lender can report negative information on a discharged debt, and repossession is certainly a negative notation. I believe this has been discussed here before, and the consensus is that the lender can only report that the loan was discharged in bankruptcy, and $0 amount remaining.
