We are going to be filing ch 7. We are working on our expenses. My husband's father passed away in February, and his mother's income was drastically reduced. We have been paying her utilities at $280 per month to help out. She is 79 years old, and has health problems. She wants to stay in her own home as long as possible. We are above median filers, and I have read in some posts that putting this as an expense could raise a red flag from the US Trustee. Has anyone else put helping an elderly parent out with expenses as an expense in ch 7? I will have receipts to prove we are paying.

I put expenses for paying for a car for my mother. It was questioned, at first, but when I said she was 80, the Trustee no longer bothered me or questioned me any longer. The bankruptcy code allows you to claim expenses for an elderly and/or disabled parent. You may need to show proof. I don't know what they'll ask for proof as this is so subjective with the Trustees.
