Discharge in Arizona?

Anyone from Arizona recently get discharged? Just wondering how long it takes. We made our last payment in November, after 5 long years this nightmare is over. Our Trustee is DK and she is a pill so I hope we get a discharge soon.

I am in PA... made my last payment in Nov. (wage attachment) . Trustee is sending another disbursement to my creditors at the end of Dec. which will still leave me with about $ 950 credit in my account. Trustee states when balance is ZERO they will put in order for discharge... SO I am thinking Feb-March cause that way I am not disappointed when it doesn't happen. I should be ecstatic cause the wage attachment ended (and I am) but patience in not my virtue ..

Congrats to you both. Sounds like a little more patience is in order, but that sure is a tough pill to swallow after five years of fighting.

I made my last payment about a week ago. I am now in a holding pattern as well hoping I at least get something telling me they are stopping the wage directive.

I'm not in Arizona, but I had to call to about mine, which prompted the court to go ahead and do it while I was on the phone. That may have actually been getting the case closed, though. Same thing, maybe if you inquire, they might go ahead and do it if everything looks okay.

fullboost... did you check pacer to see if anything was entered to end the wage attachment. I think I actually called my attorneys office & asked how long it took for it to stop and it seemed like it brought it to there attention & things started happening... I would check pacer & also with your attorney just to make yourself feel better... I feel like I collapsed at the finish line and have to crawl that last 20 yards to get across ...frustrating

I did just check PACER, it still shows "awaiting final report from trustee", but its said that for a long time with no changes.. NDC shows at "about to complete" but thats it..

I'm not sure if once you pay off the base plan if the computer triggers something with the trustee to start the discharge process somehow?

Hmmm FullBoost.. When I go into US GOV pacer I hit query- put in my case #- enter - go to history -enter- and it shows me everything that's been filed on my case such as : Order on Motion to Terminate Wage Attachment. Not sure if different states have different query's .. mine has never said awaiting final report from trustee... my NDC states the same as yours.

Yep I went into the history section and it shows various documents that were filed over the course of the last 5 years with the most recent being in october when I filed the certifications for the completion of the debtor education class. Nothing since then and no motion to terminate wage attachment.

Oh well its only been just over a week since making my last payment so I'm just impatient. HA! But after living thru a 13 for the last 5 years, I really really want it to be over and done.

The procedure to stop the wage order varies by court. Sometimes the trustee initiates it, sometimes the debtor's attorney does. You could call your attorney and tell them you just made your last payment and ask if there is anything that they need to do to make sure the garnishment stops. You could also read your court's local rules which are available on the court website.
