We filed chapter 7 in 8/03 we converted to a 13 in 04, can I convert back to a 7. I can't afford payments!!!

I may be wrong here, but since you started your whole process under the Old Law, Old Law rules may govern what you can and cannot do here.
Did you receive a discharge of the first Ch 7 filing or simply convert to Ch 13? If you received a discharge, you cannot refile. But if you converted your original Ch 7 to 13, then it may be possible.Filed Ch 7 - 09/06

Officially Declared No Asset - 03/2007
Closed - 04/2007

Hi,
I think sf is correct, you should be able to convert back to 7 under the old law,
I believe it is a relatively easy peptition with a small fee $15 or something, how-ever you will now be under chapter 7, very different rules, if you own home the trustee may now seize your house and sell it if this would be in the best interest of the creditors. If you don’t own any real property or other assets you want to keep than this may be for you.
