    Credit reporting question

    I filed my chapter 13 in August 2009. My mortgage was not included (I guess that's the correct term..I kept paying the usual monthly payment). Since next month is my 60th and last chapter 13 payment(!), I looked at my free credit report to see what was on there. Most debts show that they will be on record until August 2016, which is what I expected since it takes seven years for the chapter 13 to fall off. But my problem is that in July 2013, my mortgage was sold to another lender. And they have on my credit report that the debt was discharged July 31, 2013 by chapter 13 and they reset the reporting date to August 2020. Is that correct or are they in error? If so, how do I go about getting this corrected?

    Credit items fall off the reports from the date of default. No other date really matters when it comes to the reporting statute of limitations. That date cannot be changed when debt is sold, transferred etc. Most times the only place you can even see that date (of default) displayed is on the three direct bureau reports. Most third party's don't display that field.

    Also the date of default is the LAST date you went default (which could also be your first date of default too).

    I just re- read. Duh. Yes that date is incorrect. Dispute it. Sorry I guess I didn't read all the words. lol

      Do I dispute it with the lender or the credit bureaus?

        Hi Cubby...dispute with the bureaus. The bureaus will send the dispute to the creditor and the creditor will respond to them within x days, if they do not respond the bureau will delete. Otherwise the creditor will determine it's validity and advise credit bureau of a change needed or no change needed. If it is not fixed after that, go right to creditor directly.

          It helps if you have some supporting documentation to submit. I never got anywhere with the CRA's (especially equifax, they are the worst) until I provided documents.

            I just wanted to give an update. I disputed the date change with experian and they corrected it. Fairly painless process. After I make my LAST PAYMENT in two weeks, I'll wait until the discharge and go through all three reports with a fine tooth comb. Thanks again.
