    Change In Household Size

    Hi all. Firstly I understand I need to speak with my attorney and plan to do so this week but am curious if anyone has went through something similar. My wife and I are currently about 2 1/2 years into a 4 1/2 100% plan with a few small tax debts and two car debts. The rest are credit cards. Recently I received a court order allowing me to claim a child from a previous marriage on my tax returns starting tax year 2014. Using income filed with the case back in 2011, we would now be under the state median income. Same applies if we use current income and current median income. I'm curious to know if we would be able to convert our plan to a 3 year plan now. I had to file Chapter 7 after my first divorce in October 2006, so converting to Chapter 7 isn't possible until October. Anyone with similar case? Thanks in advance.

    I haven't had the issue arise, but the determination of your committment period is as of the date you filed BK. If your DMI has decreased, you may be able to modify your plan to get a lower payment. But I am pretty sure you cannot change your committment period unless you have a hardship that would qualify you for an early hardship discharge.
