Divorce and Ch 13 cont'd....what would you do?

    Thank you LIR....My deal was a little different in the fact that is seperated from my wife the same time i did the ch13 stand alone by myself. It helped her out bigtime since it looks like it will not forclose and she is living there free until my 13 ends. I did surrender it in my 13 and i do see it on the paperwork so maybe it will be alright. Thanks again for your help.

      It's just that I feel like he's never going to stop using me. Most spouses who cheat would have a plan and move out already, but what incentive does he have to move out? He has a place to lay his head when she has her kids. He knows I won't stop paying the bills, because that not the kind of person I am. He's still controlling me. It's just frustrating...


      We teach others how to treat us in life. You cannot control anyone else's actions or reactions BUT you have 100% control over yours. Pack up and move if that is what you need to do to get your life back if you are not strong enough to kick him out or change things in the home. Its just a house, maybe not even worth what you think its worth monetarily BUT regardless is it worth your peace of mind and freedom? He can only control you if you let him....why give someone else all that power?

        Update: I have some hopeful news. I contacted an experienced mortgage broker like you all recommended and with my income and credit situation (he pulled my credit report) there is a possibility that I could qualify for an FHA refinance. However, it would have to be done by manual underwriting. The slightly bad news is that it's getting harder and harder to find those lenders who are open to the risk of manual underwriting. Our current mortgage lender is WF. I've been told that they still do manual underwriting. There is light at the end of the tunnel.

        I'm still in limbo because I'm still waiting for my atty to send out the PSA. Will make more decisions based on his reaction of the PSA.
