    Question regarding chapter 13 and a car accident

    Hi everyone. I'm in chapter 13 and unfortunately was involved in a car accident a couple weeks ago. I've suffered bad whiplash and am now looking into hiring a lawyer (mostly to protect my medical rights). How does a lawsuit effect my case? I'm still working, the other insurance company has accepted liability and I'm in a 100% payback plan.

    Thanks for any thoughts anyhone can share.

    If the payback is 100%, it should have no affect on your bk.

      I agree that it would certainly not affect your payments. You may just want to run it by your Chapter 13 attorney. If it's a sizable offer, maybe you could payoff your Chapter 13, or is that wishful thinking.

        We had something similar happen and our Atty said because it was post-petition there was no need to notify the courts/trustee... definitely run it past your atty, they should know how to proceed.

          Thanks for your rsponses. I spoke to my attornney and he said just to keep him informed when/if there is a settlement and he will keep the trustee posted (in case he wants to be involved). I thought it was odd being in a 100% payback, but he's the boss .
