    Submitting tax returns in Chapter 13 Arizona

    We filed in April 2009, last payment will be in April 2014. It seems the closer we get to the finish line, the more nervous I get that something will go wrong.

    Since we filed my husband has become disabled & is on a kidney transplant list, also on dialysis the last year which is three times a week.

    Our income has gone up a bit & we have always notified our attorney when that happened.. he just says to continue making your payments.

    My question is do you have to send in tax returns every year while in Chapter 13?

    We are in Arizona & our order only states "The debtor will provide to the trustee within 30 days after the returns are filed, copies of his federal & state tax income tax returns for the tax years of 2009 & 2010". We have done this for 2009 & 2010 only..

    It seems the more I read about taxes, trustees might want copies of all the years you are in a chapter 13..

    We also never get a refund & always have to pay something!

      If the order states 2009 and 2010 only then your likely golden. I am ordered to show all mine while in the plan, and I receive a reminder at the first of the calendar year and a stern reminder at the deadline in April. If your not sure you could call your attorney or trustees office. Does your trustee have a website where you could ask a question or find your answer?

        Spidge is correct. The Order Confirming controls. No need to send additional returns.

        If you have not already done so, make sure you take the second (pre-discharge) credit counseling course and get the certificates of completion to your attny for filing with the court.

        In addition, you must sign the Certificate of Eligibility for Chapter 13 Discharge and get it to the attny for filing. The form cannot be filed until you have made your last Plan payment so just put this in the back of your mind and remember to do it. If the link works, the form can be found here. . .

          Thank you Des, I don't post a lot but am on this forum almost daily! Since I can't discuss our bankruptcy with family or friends this has been a great outlet! I appreciate all the support from everyone.

            Everyone here is awesome. I was discharged from my 13 several months ago but I still come here everyday too. It keeps me in check with my finances I guess. Not a bad thing though.
