Big tax refund, question

Hard to believe that we are 42 months into a 60 month plan.

We just filed our taxes and we are getting a $6k refund. My husbands income is taxes weirdly (two,pay checks and a "bonus" that's really salary but varies monthly). Turns out that we've been over withholding, and its about $600 a month.

W have a tree that's cracked the flu cation of our house, the 1960s pipes have busted twice, and my 2002 chef Tahoe needs a lot of woe,.

QUESTION- what are the chances we will be allowed to keep the return to do necessary maintenance on house and car? Does it get tacked on to the back end of the plan? Or have some trustees given a one time thing?

2nd QUESTION- in our confirmation it says something about 42 months?!?!?! Does this mean its a 42 month plan or 60 month plan?

We meet with our attorney on Monday. What specific questions should we ask etc? We will have to redo our plan since husbands income decreased and is taxed high but on paper looks like we are making more $ DMI than we are. Please help. Thanks!

If you're 42 months into your 60 month plan, then you should know if you've had to turn in tax refunds and/or returns to your trustee; it should be on your confirmation order. As to increases / decreases in income, those too should be reported, however many trustees dont require an increase report unless its around 10%. Your lawyer should know (or it may be on your confirmation order).

Dont change ANYTHING regarding withholdings until you talk to your attorney. Were you withholdings high in the beginning of your plan or did you change them at any time since filing? Where we are in VA, we must get trustee permission to change our withholdings - but as always, YMMV.
