    Foreclosure postpoment

    I would like to know if anyone has had to deal with a situation like this:

    I am in a confirmed chapter 13 for 2 and a half years now. It has been a blessing financially, but we have always struggled with the idea of keeping our home
    (UNDERWATER) in Arizona. We can afford the mortgage fine now that our trustee payment is lower than the credit cards and car payments were.

    The problem we have and I consider it Desperate (I have googled our situation a thousand times and can not find anyone else who has had to deal with this)

    is our bankruptcy was filed a few days before a trustee foreclosure sale of our house ( we decided to keep house because we are doing a lien strip)
    EVERY SINGLE MONTH for the last 2 and half years our house is listed on auction sites only to keep getting postponed to the next month. EVER SINGLE
    MONTH we deal with investors pounding on our door to see if we live here, peeking in our windows, trying to get in our backyard. Our house is very
    well kept does not look abandoned. These people are very aggressive with the shortage of foreclosures now. I am to the point where I basically hide in
    my house around the sale date it is taking its toll mentally.

    I have reached out to our paralegal who we are supposed to go thru at lawyers office several times. They have never had anyone complain about this was their answer.
    All of are arrears are paid in full as of a few months ago, we are current we pay outside plan . Why is sale not cancelled?

    Anyone know how to surrender after confirmation without ruffeling any feathers ( like to be under the radar and I have had enough drama)
    I feel like we have had ZERO protection from automatic stay as we are harrassed every single month.

    I have no idea but i would put a discreet sign on the door saying there is a mistake and the house is not in foreclosure please get off our private property and do not peer in the windows or you will be arrested for being a peeping tom!!!!!

      We actually do put up a sign each month ( will have to add the peeping tom clause to it haha). The sign is
      no help, they think we are in denial, We have seen the same people month after month. we tell them we are under bankruptcy
      protection they just dont get it. I can not even explain how hard it is to send off a large trustee and mortgage payment each month
      only to be subjected to this harassment each month. My personal favorite is the ones who think they are professional photographers
      standing in the middle of the street taking a hundred pictures. Oh I wish I had a sense of humor about this, but it feels like its taking
      years off my life.

        I'm sorry, I can only imagine. Can you not stop that process thru the county? Can you not let as many real estate agents as possible know? Who places the ad? Gotta nip this in the bud! Good luck!

            Quality loan service lists it. We have tried to talk to the lawyers for mortgage company they were reluctant for the fact that we are in bankruptcy
            but i was told that they have a bankruptcy hold until we are discharged in like another 32 months. that seems completely unreasonable if they have
            all the arrears paid back and we are current. Iam trying to get used to the idea that we just need to walk I would rather deal with a landlord for a
            couple of years at this point.

              I'm confused a little, sorry. So you were in foreclosure proceedings then filed to keep your home. You also doing a lien strip, they are a beautiful thing btw! Ok So the foreclosure process should have been stopped, but for some reason it went on anyway. I cant imagine a judge approving a LS in a foreclosed home. So because of this mistake you get to go thru initial foreclosure drama, peeping toms! Every couple of months. Seems to me the trustee or your atty needs to send a stop and desist letter!!

                The bankruptcy was filed a few days before the actual foreclosure, to stop the foreclosure it was a last minuet decision for us we were just going
                to walk and deal with credit cards on our own, but after tons of reading on this great site we learned we could do a lien strip so we thought it would
                be worth it to stay. I wish our lawyers office was responsive. I am convinced we are the only people on the planet going through this.

                  I would not walk bwcause you will have a dismissed bk and that isnt good. You need to clear it up and try to stay put if you like the house cause it will be worth it. Call your lawyer or better yet go there! This is crazy!
