    Wow! Case confirmed immediately no confirmation hearing. Whew! Who!

    Well I had my 341 meeting today and I was really scared. First of all I failed the means test because I make a little too much money and I ran up a lot of debt and I admit most was from irresponsible spending. I was expecting to get grilled a little but the Trustee only asked me the standard required questions and one about a house I sold a few years ago. That was it. Then he called my attorney over, handed him a blue booklet and informed him my case was confirmed and that there would be no confirmation hearing. I wish I had I picture of the look on attorney face when he looked over at me. He was shocked. I was just glad it was over and went so smooth. What was strange is that they had already started payroll deduction two pay periods before the 341 meeting. It makes me wonder if I was confirmed even before the meeting if that is possible. Anyway

    Almost had the same thing happen which I thought was odd. We had our 341 and our confirmation hearing was set for July 10th but got word from the attorney it was confirmed on the 1st . WooHoo!!!

      Whoops! I think I posted this in the wrong forum. Maybe should have posted to the 341 forum.

        Christine88, you are fine. You posted this in the Chapter 13 forum, and that is more what this was about--your Confirmation--than specific 341 matters.

            I guess we were also lucky as our lien strip was confirmed the day before our 341 and our plan confirmed at the 341. We were given our file and little blue book as we all walked back to the attorneys office around the corner from the court house. Total time in front of trustees representative about 45 seconds. I don't think we even kept the seats warm.

            Fingers crossed our luck continues, and yours too.

                Five years. The petition was filed May 29th so I guess creditors have less than 60 days to object? Or is it 60 from the 341?

                  It is 60 days from the 341 Meeting. Unless there is a mortgage or car where the interest rate may be questionable, most creditors do not object to confirmation.

                    I've been doing some reading and its my understanding that once a case is confirmed the terms are binding on all parties. So since my case is already confirmed then there is no 60 day period. The creditors cannot object? Am I confused?

                      I was talking about the claims bar date. Right now, your confirmed plan is based on what you submitted and maybe not all the "actual" claims. That claims bar date is up to 90 days past the 341 Meeting. I can't tell you what they do in your specific District since it appears you can confirm on the same day as the 341 Meeting. In my District, we wait for everything, including the claims bar date and other motions, before confirming a plan. That way there are no questions upon confirmation.

                        Well I'm in SC but I'm not sure how they do things here. It still blows my mind that the trustee pronounced that my case was confirmed and there would be no confirmation hearing. The only thing I can figure is that my case is really simple. I'm not married, have no kids, keeping my car. I guess all my paper work must have been in complete order.

                          A well-submitted Chapter 13 case does happen at times. As you stated, the paperwork must have been pristine!
