    Sammie,
    No One will come in and look over what is in your home and take it. Like AC said price it like its at the end of a raining day yard sale and you just want to get rid of it so you don't have to pack it back up.

      IIRC, some of Sammie's income is from SS. It won't count on the means test but will count on Schedule I. A CH7 would be a big blessing for Sammie.

        sammi- Good luck with that. We are also in NC and I wish we could have had a chapter 7 but it would have meant we loose our house and possibly my father in laws house (complicated situation). We are in a similar situation but are having to scrounge every month to make it. I do not work during the summer and I am a substitute teacher during the school year (they only pay us $70/day and you are not guaranteed work). This makes things really difficult. The trustee (WLT) refuses to reduce our payment saying we came in too high on our claims (claims came in from medical bills months after we filed BK13 and they allowed them to make the claim putting us higher on claims than they should have). I wish you the best and hope that you can convert. My disability has not been approved yet (LONG battle). Good luck.

              Hello everyone! I am sorry I did not get back to you sooner. I called the Attorney's office Monday & we have an appt. to see our Attorney on July 23rd. The Para-Legal called me yesterday & I explained our situation & she informed me that there would be no benefit in converting to a 7 since they cannot strip either Mortgage due to the fact our first Mortgage is much lower than the value of our home. Basically what JC said in her post. She said when we come in the Attorney will discuss a Mortgage Modification, but said it could only be done on the first Mortgage. She said that since our 13 takes care of all our CC debt and this why we filed in the first place, it would be senseless to convert.

              So, I guess that is it! The value of our home is more, but with the combined 3 Mtges. we would owe money if we try and sell. So, we will stick it out with $16 in our checking account after paying the bills and plug along until we can longer do so.

              I will let you know what he says when we see him in two weeks. Thank you for being here for me, It means a lot.

              We sat down and wrote a very long email this morning to the President of the Hospital disputing the bill--we will see what happens with that too! KS I did keep the Jersey girl out of saying what was really in her head when I wrote it.
