    How to deal with third party collection agencies after chapter 13 discharged?

    My husband and I were successfully discharged in July 2012. Recently in the past few weeks my husband has been receiving phone calls from debt collectors about old debts that were included in our bankruptcy case. I know that we are current on all of our bills. I did find out that the electric company from our previous address two years ago sent our final electric bill to an old mailing address. I am willing to pay for that bill not ones that were paid off through our case.

    Should I contact my trustee or bankruptcy attorney? I know that my attorney notified me that sometimes these third party agencies will try to collect on a paid off debt. I know that bankruptcies are public record and I believe that these companies have our public record and are trying to collect on some of the claims. I have found out also that our case will be removed from our credit file in October or the first of November. We filed on November 2006.

    You pay off nearly $80K of old debt. You pay the trustee on time for over 5 years. You deal with living on a shoestring budget. Then when the case is finished you think that these old debts are finally over. Congress needs to pass stricter laws on collection agencies. I believe that bankruptcies should be private and not for the public. I can't even talk to my husband's doctor or a nurse without his permission. If I wasn't allowed to discuss his health issues with his doctor then what gives a debt collector the right to scour my personal credit history! I believe businesses have the right to public records but not your private credit history especially with ID theft.

    Verify that the debts were indeed listed in your Chapter 13 filing. Provided they were, you need to inform the 3rd party with your case number and date of discharge, then follow up and mail them a copy. (Certified perhaps?)

    Then, if the calls/letters continue, talk to your attorney.

      Or just ignore them. Don't take their calls, they will go away because in spite of what they may say they do know you filed BK on those debts. They are bottom feeders that DO take advantage of people that do not know any better Or they haven't yet found this forum! I wouldn't waste a dime on mailing them anything.
