    Custodial Accounts

    Hi, We filed a Chapter 13 last summer. At that time the technology fund that I had was listed on the paperwork. My daughter is now 18, can she take the money from that account? I am set up as the custodian? Trying to get in touch with my attorney, but no luck so far.

    Just wondering if anyone knows.

    First, Chapter 13s are special in that you get to keep your assets. Since this is a custodial account, it is not your account and it does not belong to the bankruptcy. In fact, when (the super-majority of) plans are confirmed, all property of the debtor are "re-vested" in the debtor. That means that everything is yours once again.

    Continue to reach out to your attorney. Call 2-3 times a day and leave messages.
