    Data Center says closed but have not heard from Trustee

    I made my last payment last month on Feb 1. I have not yet heard from the Trustee since my last payment. But The National Data Center shows all the numbers adding up and is now showing my case as closed as of 03-03-13. I know the National Data Center is not official but if it says closed would that mean the discharge has already been done and my case is closed? Got an email in to my lawyer but thought I would ask here also.

    You really answered your own question before you asked it. Maybe, but not necessariliy. The only way to know for sure is to check PACER. I'm sure your attorney will do that and let you know.

    $143,000 in debt discharged for $36,500, including attorneys fees. Money well spent!

      When the National Data Center lists a BK 13 case as "closed", it only means that the debtor's plan base amount in terms of dollars has been met. That status can only appear when the trustee's office acknowledges the fact.
      You should be getting a snail-mail letter from the trustee instructing you to cease payments, or have your employer stop the wage execution. The letter will also give you other details as to what you need to do in order to get the discharge.

      Your case is still officially "open" even after you eventually obtain the discharge. It takes about one month before the Bankruptcy Court closes the case after the discharge has been granted. Case closure will be the last document listed in PACER.

      To reiterate: NDC "closed" refers to having finished the payments, and PACER "closed" is the actual and final closure of the bankruptcy case itself.

        Mine still reads closed and my case was either discharged or dismissed (see my thread about that) last May.

          I actually got a letter from the Trustee when I got home from work a few hours after I typed the original message. It was a recommendation for discharge to the court or something like that. Don't have it on me right now.. The same letter was also sent to he creditors telling them they have 30 days to object.. Getting close.. Anyone ever have a creditor object to discharge? All my unsecured cc debt was bought by Ecast. All secured debt was paid off 100%.
