    conversion from 13 to 7 question

    so i am 3 1/2 years into 13 plan. but may have a job opportunity and have to move. spouse income will go away so if you do a means test, is it based on past income or future.

    also, what do i do with my upside down house with a lien strip mortgage. do i give it up? do i try to keep it. still under water without a second.

    i also owe back property tax so i need to get on a payment plan if i try to keep the house.

    if i can concert, how soon after do i have to move out? i would move back east in the summer.

      I dont know much but if you want to stay in bk and just rent out your place, is that an option? Seems to me u could stay in bk just might have to pay more or less based on your new job and expenses? I think it depends on what you want to do.

          great question. i am not sure why taxes were not accounted for. i think it would have put me in a chapt 7 at the time and we didnt want to lose the house.

          but i realize i can rent out the house and it should cover the payment but wouldnt be able to afford an empty house and it would get ugly if i missed payments.

          I am worried about how the the process is of going from chapt 13 to 7. do i just do a new means test? i am in southern california. also is the means test based on future income?

          i want to get feedback from this group first before i ask my attorney questions as i always seem to forget things once talking to the attorney.
