I looked at the form, I know insolvency but then what do I do? It states that they will make the correction if I send the information. Not sure what to send. Can anyone help me?

OMG! I was about to post the same thing! I got a letter today for my 2011 taxes too. They say I will owe $1,500. Mines was for a cancelled debt by Capitol One; they sent the 1099 but I never did anything with it since they were included in my BK. They did not file a claim on BK either. I was looking at the form but it is confusing as hell! Help!CH13 - filed 30 JUL 09, $1521 @ 60 mos (100% payback)

hmm recently posted this thread to explain exactly how and what to do: http://www.bkforum.com/showthread.ph...-or-bankruptcy
it would be best for both of you to consult a tax person such as an accountant and have them do your 2011 and amend the return to include the 1099 and or have them answer the irs request letter, by attaching the 982 filing it out for you (usually section a is either 1a or 1B) section II can vary. usually a copy of your discharge order is perfect and or your docket number...since i can't see your letters i can't see what exactly they want you to submit to proof your insolvency. remember if you filed bk and the debt was discharge that IS proof of your insolvency.8/4/2008 MAKE SURE AND VISIT Tobee's Blogs! http://www.bkforum.com/blog.php?32727-tobee43 and all are welcome to bk forum's Florida State Questions and Answers on BK http://www.bkforum.com/group.php?groupid=9

again, even tho i have dealt with many returns i would have someone in the field review what you are submitting to make certain it is done correctly. it really is a small price to pay to make certain all the i's are dotted and the "t"s crossed.8/4/2008 MAKE SURE AND VISIT Tobee's Blogs! http://www.bkforum.com/blog.php?32727-tobee43 and all are welcome to bk forum's Florida State Questions and Answers on BK http://www.bkforum.com/group.php?groupid=9

Finally something I can help with. Haha
Just call the number that's on the letter the IRS sent you. Explain to them that the debt is included in your bankruptcy. I did this a couple of months ago. They took a recorded statement and that was it. 2 weeks later I got a letter from them clearing me of the taxes owed. The lady was very helpful and said they are trying to eliminate paper being sent in unnecessarily.
Even if it doesn't go down for you like it did for me, the people working there will tell you how to exactly resolve it. I know all of the horrible things people say about them, but every issue I've ever had they were friendly and easy to deal with as long as you did exactly what they said to do.

me too, i actually have only had "good" experiences with the irs and have always found them to be very helpful with questions and answers. very cool about the recorded statement, however, i would certainly get some type of confirmation number for your records or some type of verification number to assure the problem was in fact resolved8/4/2008 MAKE SURE AND VISIT Tobee's Blogs! http://www.bkforum.com/blog.php?32727-tobee43 and all are welcome to bk forum's Florida State Questions and Answers on BK http://www.bkforum.com/group.php?groupid=9
