I made my 54th and final payment on August 20, 2012.
13 Data Center showed my case as "Closed" on September 6, 2012.
Trustee sent me a letter telling me that I had made all of my payments and I would receive a discharge within 120 days of the date of the letter, pending audit of my case and submission of the Trustee's Final Report. The letter also stated that if I did not receive the discharge within 120 days of the letter, I should contact my attorney.
I did not wait for 120 days to contact my attorney. On Monday 12/17/2012 I went to his office and told him that I have been monitoring PACER for the past three months and there is no sign of the Trustee's final report having been submitted. He said he would send the trustee a letter indicating that my case has been closed for over 3 months, but that he could do nothing else to expedite the process. The trustee and the BK court both move at their own pace, like it or not.
I logged into PACER this morning (12/19/2012) and, lo and behold: both the Trustee's Final Report and my official Chapter 13 Discharge were there - logged on Tuesday 12/18/2012.
So that's it. I have no idea if contacting my attorney on Monday had anything to do with the appearance of my discharge on Tuesday. It could have been a mere coincidence.
I live in New Jersey. Waiting 3 to 4 months for a Chapter 13 discharge after a case is closed is New Jersey "normal". I was told that when I last appeared in my attorney's office in August, and the message was repeated in the Trustee's letter to me in September.
Just as an aside: the audit procedure after the close of a Chapter 13 case has only to do with the trustee's internal accounting procedures. It is not a look back into the past to see if any issues have been bypassed or overlooked.
