    Chapter 13 new means test

    I'm converting to a Chapter 13 from a Chapter 7 due to some accidental miscalculations that made me qualify for a Chapter 13.

    Aside from the lawyer contacting the Trustee to notify him of the conversion and a motion being filed. What sort of paperwork is to be expected? I'm assuming I'll be doing a new means test to calculate income/expenses and submitting(or amending) my already filed schedules.

    What all is involved with this process? I'm just trying to educate myself as to how it all works.

    I did a google search but it didn't really tell me all that is involved.

    You attorney will probably file a new Means Test using Form B22C. Form B22C is specific to Chapter 13s, while Form B22A is specific to Chapter 7s. There isn't much in the process. You get a new 341 Meeting date and have a new 341 meeting with the Chapter 13 Standing Trustee. You then go through confirmation and that can take anywhere from immediately to 90+ days after the 341 meeting depending on your local District rules and customs. (In Florida, we confirm at 120 days past the 341 meeting date. Technically, the confirmation is supposed to be held within 30 days of the 341 meeting date. In Florida, we hold a "preliminary" confirmation hearing and just continue it to 30 days beyond the last day to file a claim.)

      Thanks for your help again. I assume this is where we can recalculate my income (re: the items that were missed the first time) and make sure my expenses line up with the budget as well? You explanation of the process really helped.

        When you complete the new Schedule I/J and Means Test (Form B22C), you should really make sure the numbers are good and provide for a "feasible" Chapter 13 Plan.

          That's the goal. I've accounted for everything even the things that slipped through the lawyer's hands. Thanks again JB.
