    Minor panic attack....what is this

    I feel like I am on a stake out until we get confirmed fully but I look each week to see who has filed a claim and save the docs that are in the account to a file on my PC. Today I look to find out and see that there is a "Notice of Defective Entry or Filing"

    It states:
    NOTICE OF DEFECTIVE ENTRY OR FILING
    NOTICE IS HEREBY GIVEN that the Amended Chapter 13 Plan filed in the above referenced case on 10/05/2012
    as document # 21 is defective for the reason(s) marked below:
    Plan Motions (Ch. 13) event required.
    PLEASE TAKE NOTICE that this should be corrected immediately to allow for timely processing of the
    case/proceeding.


    what is this? We were told at our 341 that they needed to change some of the wording on our petition because my DH's on the Deed to my Father in Laws house in SC. So they submitted the changes then this pops up. I do not want anything to happen to our case and seeing this probably shouldnt make me nervous but it does. HELP!

    Also last question for the day (I hope), when does the Trustee disburse funds to creditors? Our payment is still sitting there that we sent in on the 22nd of September. I hate that money just sitting there.

    As far as when the trustee distributes funds from your account base - that will not even begin to happen until your Chapter 13 plan is confirmed. Plus, it makes no difference whatsoever to the debtor (as far as the case goes) or the creditors (the automatic stay prevents them from any kind of action except waiting) when the money gets disbursed, so do not waste a single calorie of mental energy on that topic.

    Better get with your attorney on the "defective entry or filing" issue. It's probably not as bad as you think.

      This is no big deal. Even a typo that could change a meaning of a word or sentence has to be corrected. It is a clerical thing and other than holding up the case a bit, should not concern you. Even the PACER people have had to fix an error and everything shows as once posted it is a legal document. Hang in there, and keep the faith. 'Hub

        Thank you. It did make me nervous but since you put it that way I am breathing a sigh of relief.

          Spot on answer. Defective pleadings are a dime a dozen, mostly for very petty things. The bk clerks however, do their job very well in catching them.

              Where can you go online to see what is going on? My lawer never told me anything about that? Thanks
