I've filed for chapter 13 and awaiting confirmation. Our plan includes the trustee making the payment to Toyota Financial (and a pre-confirmation adequate protection payment can be made if requested when they file their claim). As of today, they have not filed a claim or requested a Pre-Confirmation Adequate protection payment.
They sent a letter to our attorney with a copy to us saying basically they are following all the bankruptcy laws. They put if we want to make voluntary payments we can do so by mailing the monthly payment to a specified address.
Should we be receiving this letter or do we need to do anything? Should I call our attorney for clarification?
I just assumed if the car payment was part of the plan (100% payback plan) we wouldn't be asked to make voluntary payments if we wanted to.
Any info on this subject would be appreciated.
