    JP Morgan Chase...Grrr

    Once again, my mortgage lender continues to confuse the heck out of me. Being in a Chap 13, they took away my online account access. So every few months, I call to make sure my account is ok, even thought the trustee makes my payments. The other day I called and Chase told me my next payment due is December 1, 2012. What the heck? I havent paid them any extra money and I keep track of my trustees payments on 13datacenter.com. I asked for and just received in the mail my payment history from Chase. Its 16 pages dating back to Aug 2010 when I started my Chap 13. Its very confusing. I dont understand any of it. It shows payments of all different amounts, some in the negative (a minus sign next to the number). There are also transactions saying "corporate advance paid", "corp adv attorney adv disb", "misapplication reversal". These are all different amounts. Now this is all during Chap 13 so if these are fees they are charging me, isn't that against the law? And the payment due in Dec 2012 is $300 less than my normal monthly payment. I tried loan modification before bankruptcy, but it was denied after months of "lost paperwork" on their part. Since then, they offered a modification which I did not respond to. I do plan on calling Chase, but I'm trying to get some info first. Any advice or help would be appreciated. Thanks.

    I would not call them at all. A confirmed Chapter 13 Plan either explicitly or implicitly deems ALL PAYMENTS received timely by the Trustee as timely payments to the creditors.

    Methinks you are creating confusion on for yourself.

    Just wait until the end of the Chapter 13 and then reconcile at that point. If the creditor tries to charge you for fees, which are not allowed in a Chapter 13 unless approved by the court, then you would have your attorney motion to have the fees quashed, as they should be.

    Please know that accounting for your mortgage is DIFFICULT for almost every lender during a Chapter 13. Their systems are just not prepared to handle the issues! Their systems may automatically add late fees and put amounts into suspense when they should be applied to the "balance" (not including arrears).

    So my advice... stop calling Chase, and stop looking at 13DataCenter. (Unless you're only looking at 13DataCenter to see if "your" payment was received by the Trustee. Even so, you do not need to do that all the time.)

      Justbroke, I can't help being so paranoid after dealing with Chase. I tried desperately to do a modification and was reassured by them that they didn't want to take my house. It was less than 30 days till the auction date when I filed Chap 13. I trusted them till it was almost too late. Its hard to get that bad taste out of my mouth. My attorney also tells me to just make my payments and let the trustee do the work. I'll try a little harder to relax, but I can'tmakeany promises, lol. Thanks for the reassurance.
