New Here...Monday Sell Date. Filing Emergeny bk on Friday...
Doing a lot a research. Just found out today we need a counseling certification. Got that done. Can someone share the forms we need to file an emergency. Live in Fontana, Ca. Filing in Riverside.
Find an attorney today! If you're posting in the ch. 13 forum, then I'm assuming you expect to be in some sort of payback plan. Majority of your attorney fee can probably be paid in the plan. It should be possible to file an emergency petition and then get the full plan in within 2 weeks. But its unwise to file any ch. 13 pro se, especially if you haven't taken the time and effort to research to the extreme before filing. Sounds like you have not, so get legal help before its too late!

Yes, get to an attorney today! Do not file a Chap 13 pro se. The need for a counseling certification is only the tip of the iceburg of things you probably do not know that you should if you are going to represent yourself. If you need to post here to get help finding the necessary forms, you are far from being prepared to do this on your own. It is really easy to find BK forms. It is not so easy to fill them out correctly and get a Chap 13 plan confirmed. Once you file that petition, there is no turning back gracefully and it is next to impossible to get an attorney to take over a case after you have already filed it.
Get on the phone NOW and start calling BK attorneys in your area. Make it clear that you need to file an emergency petition to stop foreclosure sale scheduled for Monday! Bring copies of current account statements, credit card and mortgage bills and pay stubs with you when you meet. Even if they don't need to complete the schedules right away, they will want to have a good overview of your finances before filing a petition.

$143,000 in debt discharged for $36,500, including attorneys fees. Money well spent!
