    when does the 5 years start?

    does the 5 years start when you make your first payment or when it get confirmed? i live in ny state...thanks again

    For most places, it's from first payment.
    In Michigan, it's from confirmation. Maybe some other places but that's the one that keeps coming up. Frankly I think that should be outlawed. I really think that's a gross misinterpretation of intent.

      The time starts from the first payment. After conformation is just a formality everything revolves around file date and payments.

        So filed in late November, but 341 was early January with 1st payment in hand. Was that my December or January payment. My guess was Decemebr so made another payment shortly after for January. If we are a bit ahead, great.
        11/23/'10-filed ch 13. 1/6/'11-341, confirmed. Below median. Plan completed 11/30/2015. DISSCHARGED 4/4/2016.JP

          In MA, the clock starts ticking on the day of the 341.

            I just asked my lawyer (MA). He told me it starts at the first payment.

                Generally the 341 is about 30 days after you file, and the first payment is due 30 days after you file. So in a normal world its the same thing.

                Sometimes a district gets a little backed up, so the 341 may be delayed by a week or two. That doesn't change your payment due schedule though.
